Actually, people did testify about the use and impacts of the streets in question--last week at the hearing and in written testimony to ACHD. I know because I was one of them. BSU is playing a bit loose with what happened in ACHD&#039;s public testimony. BSU&#039;s request is an effort  to claim ownership over who knows best how those streets are and should be used. 

These are the people&#039;s streets--citizens of Ada County and of Boise, whose histories of using these streets never seemed a question until this letter tried to paint opponents as disinterested in the matter.

BSU would erase a public venue while overplaying its history of agreements as if those were unrevisable. The aim is exclusive ownership of streets through subtractions of legally binding forums where people can count on the right to be heard. An academic institution can do better than this reductive display of bureaucratic and legalistic sensibilities that would end consequential public action on the matter. By a 4-1 vote, ACHD took the public into account -- and BSU&#039;s incomplete application plans -- to end exclusive ownership claims to the streets.

Problems any of us may find with representative bodies and institutions of public trust do not justify taking any venues for public discourse out of the picture. But this move does just that. Fix representation procedures when and if necessary. But any effort to reduce the public&#039;s role in consequential public decisions weakens democracy and, I dare say, the university that would do such a thing.]]></description>
