The Idaho Attorney General has issued an opinion that Boise cops can write tickets for violation of city open booze container ordinances on the Boise River–just like they do on state highways within the city.
Last month when it looked like a crack down on open containers was imminent, there was a pretty strong reaction to those river floaters who enjoy their brews, prompting a request from Boise City lawyers for an opinion from the AG.
The City Council was prudent in asking for the AG opinion and Councilor Dave Eberle has publicly urged some restraint on the part of police and even asked for more discussion by the Council about enforcement policy –we are making progress when the council does business in public, seeks a second legal opinion, responds to public input, and even appears to be taking the lead determining public policy by offering some direction to our cops. What a city!
